How a 1031 Exchange Works

Three moves. Zero tax bill today. Command the timeline — don't let it command you.

STEP 1

Sell Your Investment Property

Close the sale of your investment property and open the exchange with a qualified intermediary — before you touch the proceeds.

STEP 2

Identify Within 45 Days

You have 45 calendar days from the sale closing to formally identify your replacement property. The clock starts the day you close — no extensions.

STEP 3

Close Within 180 Days

You have 180 calendar days from the sale closing to close on the replacement property and complete the exchange.

Why Alabama Investors Use It

The investors who build real wealth don't pay taxes they can legally defer. They redeploy.

  • ✓Defer capital gains taxes — keep the IRS out of your equity and put every dollar back to work.
  • ✓Keep more equity working — compound your portfolio instead of shrinking it with a tax bill.
  • ✓Upgrade or diversify — trade up to stronger markets, better cash flow, or new asset types across Alabama.
  • ✓Build long-term wealth — stack exchanges over years and scale your Alabama holdings like the pros.

1031 Exchange FAQs

What is a 1031 exchange?

A 1031 exchange (named for Section 1031 of the tax code) lets you sell an investment property and defer capital gains taxes by reinvesting the proceeds into a like-kind replacement property — following strict IRS timelines.

When do the 45-day and 180-day deadlines start?

Both clocks start on the same day: the closing date of your sale. You then have 45 calendar days to identify replacement property and 180 calendar days total to close on it. Miss either deadline and the exchange fails.

What counts as like-kind property?

Like-kind is broad for real estate: almost any investment real estate qualifies — single-family rentals, multifamily, commercial, land. Your personal residence does not qualify.

Do I need a qualified intermediary?

Yes. The IRS requires a qualified intermediary to hold the proceeds between the sale and the purchase. You cannot touch the funds yourself — doing so disqualifies the exchange.
